Should I Submit to the Breathalyzer Test?

By the time you have read this, you probably made your decision to submit to the test or to refuse the breath test. I have defended people who have done both. The following is helpful for you to know if you have been arrested for DUI.

  • If you refuse the breathalyzer your license will be suspended for one year or for a period of 18 months if your drivers license has been previously suspended as a result of a refusal to submit to a breath test
  • If you submit to the breath test and blow a .08 blood alcohol level then your license will be suspended for six months for a first offense or for a period of one year if your driving privilege has been previously suspended for DUI.

Can I challenge my suspension for DUI?

You can challenge the administrative suspension for refusing the breath test and for blowing over the legal limit but you must do so within 10 days of your arrest.
